Terms of Service

Welcome to OAV™ (“OAV”, “we”, “us”, or “our”), operated by OneAuctionView LLC. By accessing or using oav.io, app.oav.io, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Description of Service

OAV is an AI-powered vehicle discovery platform that aggregates publicly available vehicle listing data from automotive dealers and provides pricing intelligence, market analysis, and connection services between consumers and dealers. OAV does not buy, sell, or broker vehicles directly.

2. Consumer Use

Consumers may search and view vehicle listings, market analysis, and pricing data free of charge. Consumer use is subject to the following:

  • You must be at least 18 years old or the age of majority in your jurisdiction.
  • You agree not to scrape, harvest, or automate data extraction from the Service.
  • Connection requests submitted to dealers may be shared with that dealer for the purpose of facilitating vehicle inquiries.
  • Market analysis and deal ratings are estimates based on available data and should not be construed as appraisals or financial advice.

3. Dealer Subscriptions

Dealers may subscribe to activate contact features and access analytics dashboards. Subscription tiers and pricing are displayed at the time of activation. By subscribing, you agree that:

  • Subscription fees are billed monthly in advance and are non-refundable.
  • Subscriptions automatically renew until cancelled.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • OAV reserves the right to modify pricing with 30 days’ notice.
  • Payment processing is handled by Stripe, Inc. and subject to Stripe’s terms of service.

4. Data Sources and Accuracy

Vehicle listing data is aggregated from public dealer inventory feeds. While we strive for accuracy, OAV does not warrant that listings are current, complete, or error-free. Vehicle availability, pricing, and specifications are subject to change by the dealer without notice. Consumers should verify all details directly with the selling dealer before making purchase decisions.

5. Pricing Intelligence

OAV’s Price-to-Market (PTM) analysis and deal ratings (“Great Deal”, “Fair Price”, “Overpriced”) are generated by algorithms using comparable vehicle data. These ratings are provided for informational purposes only and are not guarantees of actual market value, resale value, or future pricing.

6. User Content and Conduct

You agree not to:

  • Use the Service for unlawful purposes or to violate any rights of third parties.
  • Interfere with the operation of the Service or introduce malware or security vulnerabilities.
  • Misrepresent your identity or affiliation with any person or organization.
  • Use automated tools to submit false inquiries or connection requests.

7. Intellectual Property

All content, branding, and data aggregation methods on OAV are the property of OneAuctionView LLC or its licensors. You may not reproduce, redistribute, or create derivative works without prior written permission. Vehicle listing data remains the property of the originating dealer or data provider.

8. Disclaimers

The service is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. OAV does not guarantee that the service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, OAV and OneAuctionView LLC shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or lost data, arising from your use of the service. OAV’s total liability for any claim shall not exceed the amount you paid to OAV in the 12 months preceding the claim, or $100 if you have not paid any fees.

10. Indemnification

You agree to indemnify and hold harmless OneAuctionView LLC, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification shall survive termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email (for subscribers) or posted on the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Orange County, California.
